COPYRIGHT POLICY

All visuals, pictorial works, illustrations, designs, and other artistic content published on artsanat.gallery are protected under Turkish Law on Intellectual and Artistic Works No. 5846 (“FSEK”) and applicable national and international legislation.

Unless expressly stated otherwise, the copyrights of all works belong to the respective artists. No content may be copied, reproduced, distributed, modified, republished, transmitted, or used, in whole or in part, for commercial or personal purposes without the prior written consent of the rights holder. Digital display of works is permitted solely for promotional and sales purposes within the scope of this platform.

For works purchased through artsanat.gallery, only the right to use the physical or digital copy is transferred to the buyer. No transfer of copyright occurs. All reproduction, distribution, public communication, representation, and adaptation rights remain exclusively with the artist.

Any unauthorized use, copying, reproduction, modification, or distribution constitutes a violation of Law No. 5846, and artsanat.gallery and the respective artist reserve the right to pursue all available legal and criminal remedies.

All content on the platform is published with the explicit declaration and consent of the artists. Requests, notices, or claims related to copyright must be submitted in writing to:

Protection of Moral Rights

The moral rights of authors are strictly protected. The artist’s name, signature, or pseudonym and the integrity of the work must always be preserved. No work may be cropped, altered, distorted, or used out of context in any manner that compromises its integrity or omits attribution.

Any modification, reproduction, publication on another medium, or use for a different purpose without the artist’s explicit consent is strictly prohibited. In the event of infringement, the artist reserves the right to directly and independently pursue all legal remedies.

artsanat.gallery undertakes to protect the moral and economic rights of artists and, upon request, reserves the right to remove content, restrict access, and initiate legal proceedings.

Author Protection Guidelines

Artists are personally responsible for protecting their works. The following measures are mandatory:

  1. Automatic Protection: Copyright protection arises automatically upon creation. No registration is required.

  2. Proof of Authorship: Notarization, e-Government timestamping, registered digital archiving, or equivalent methods must be used.

  3. Identification: The artist’s name, signature, or pseudonym must be clearly displayed.

  4. Low-Resolution Publishing: Online publications must be in low resolution. High-quality originals must be retained.

  5. Contracts: Sales must explicitly state that copyright is not transferred and only usage rights are granted.

  6. Monitoring: Unauthorized use must be actively monitored and immediately acted upon.

  7. Integrity Protection: Alteration, cropping, or contextual misuse is strictly prohibited.
